You've seen some of the funny LATMA videos here that satirize the problems of living in one of the most hostile neighborhoods in the world. Ronit Avrahamof Shapira was in the car with her husband and babies when terror smashed through their window. INN  (h/t Liz) Shapira told the tale on her Facebook page: "An Arab terrorist […]

The Declaration of Independence in American

The Declaration of Independence in American
H.L. Mencken
Baltimore Evening Sun, Nov. 7, 1921.

WHEN THINGS get so balled up that the people of a country got to cut loose from some other country, and go it on their own hook, without asking no permission from nobody, excepting maybe God Almighty, then they ought to let everybody know why they done it, so that everybody can see they are not trying to put nothing over on nobody.

All we got to say on this proposition is this: first, me and you is as good as anybody else, and maybe a damn sight better; second, nobody ain't got no right to take away none of our rights; third, every man has got a right to live, to come and go as he pleases, and to have a good time whichever way he likes, so long as he don't interfere with nobody else. That any government that don't give a man them rights ain't worth a damn; also, people ought to choose the kind of government they want themselves, and nobody else ought to have no say in the matter. That whenever any government don't do this, then the people have got a right to give it the bum's rush and put in one that will take care of their interests. Of course, that don't mean having a revolution every day like them South American yellow-bellies, or every time some jobholder goes to work and does something he ain't got no business to do. It is better to stand a little graft, etc., than to have revolutions all the time, like them coons, and any man that wasn't a anarchist or one of them I.W.W.'s would say the same. But when things get so bad that a man ain't hardly got no rights at all no more, but you might almost call him a slave, then everybody ought to get together and throw the grafters out, and put in new ones who won't carry on so high and steal so much, and then watch them. This is the proposition the people of these Colonies is up against, and they have got tired of it, and won't stand it no more. The administration of the present King, George III, has been rotten from the start, and when anybody kicked about it he always tried to get away with it by strong-arm work. Here is some of the rough stuff he has pulled:

He vetoed bills in the Legislature that everybody was in favor of, and hardly nobody was against.

He wouldn't allow no law to be passed without it was first put up to him, and then he stuck it in his pocket and let on he forgot about it, and didn't pay no attention to no kicks.

When people went to work and gone to him and asked him to put through a law about this or that, he give them their choice: either they had to shut down the Legislature and let him pass it all by himself, or they couldn't have it at all.

He made the Legislature meet at one-horse tank-towns, so that hardly nobody could get there and most of the leaders would stay home and let him go to work and do things like he wanted.

He give the Legislature the air, and sent the members home every time they stood up to him and give him a call-down or bawled him out.

When a Legislature was busted up he wouldn't allow no new one to be elected, so that there wasn't nobody left to run things, but anybody could walk in and do whatever they pleased.

He tried to scare people outen moving into these States, and made it so hard for a wop or one of these here kikes to get his papers that he would rather stay home and not try it, and then, when he come in, he wouldn't let him have no land, and so he either went home again or never come.

He monkeyed with the courts, and didn't hire enough judges to do the work, and so a person had to wait so long for his case to come up that he got sick of waiting, and went home, and so never got what was coming to him.

He got the judges under his thumb by turning them out when they done anything he didn't like, or by holding up their salaries, so that they had to knuckle down or not get no money.

He made a lot of new jobs, and give them to loafers that nobody knowed nothing about, and the poor people had to pay the bill, whether they could or not.

Without no war going on, he kept an army loafing around the country, no matter how much people kicked about it.

He let the army run things to suit theirself and never paid no attention whatsoever to nobody which didn't wear no uniform.

He let grafters run loose, from God knows where, and give them the say in everything, and let them put over such things as the following:

Making poor people board and lodge a lot of soldiers they ain't got no use for, and don't want to see loafing around.

When the soldiers kill a man, framing it up so that they would get off.

Interfering with business.

Making us pay taxes without asking us whether we thought the things we had to pay taxes for was something that was worth paying taxes for or not.

When a man was arrested and asked for a jury trial, not letting him have no jury trial.

Chasing men out of the country, without being guilty of nothing, and trying them somewheres else for what they done here.

In countries that border on us, he put in bum governments, and then tried to spread them out, so that by and by they would take in this country too, or make our own government as bum as they was.

He never paid no attention whatever to the Constitution, but he went to work and repealed laws that everybody was satisfied with and hardly nobody was against, and tried to fix the government so that he could do whatever he pleased.

He busted up the Legislatures and let on he could do all the work better by himself.

Now he washes his hands of us and even goes to work and declares war on us, so we don't owe him nothing, and whatever authority he ever had he ain't got no more.

He has burned down towns, shot down people like dogs, and raised hell against us out on the ocean.

He hired whole regiments of Dutch, etc., to fight us, and told them they could have anything they wanted if they could take it away from us, and sicked these Dutch, etc., on us.

He grabbed our own people when he found them in ships on the ocean, and shoved guns into their hands, and made them fight against us, no matter how much they didn't want to.

He stirred up the Indians, and give them arms and ammunition, and told them to go to it, and they have killed men, women and children, and don't care which.

Every time he has went to work and pulled any of these things, we have went to work and put in a kick, but every time we have went to work and put in a kick he has went to work and did it again. When a man keeps on handing out such rough stuff all the time, all you can say is that he ain't got no class and ain't fitten to have no authority over people who have got any rights, and he ought to be kicked out.

When we complained to the English we didn't get no more satisfaction. Almost every day we give them plenty of warning that the politicians over there was doing things to us that they didn't have no right to do. We kept on reminding them who we was, and what we was doing here, and how we come to come here. We asked them to get us a square deal, and told them that if this thing kept on we'd have to do something about it and maybe they wouldn't like it. But the more we talked, the more they didn't pay no attention to us. Therefore, if they ain't for us they must be agin us, and we are ready to give them the fight of their lives, or to shake hands when it is over.

Therefore be it resolved, That we, the representatives of the people of the United States of America, in Congress assembled, hereby declare as follows: That the United States, which was the United Colonies in former times, is now a free country, and ought to be; that we have throwed out the English King and don't want to have nothing to do with him no more, and are not taking no more English orders no more; and that, being as we are now a free country, we can do anything that free countries can do, especially declare war, make peace, sign treaties, go into business, etc. And we swear on the Bible on this proposition, one and all, and agree to stick to it no matter what happens, whether we win or we lose, and whether we get away with it or get the worst of it, no matter whether we lose all our property by it or even get hung for it.

The last few days in Egypt reflect the nature of all political systems: as states are defined as systems enjoying a monopoly on the use of violence within a given territory, their origins lie in conquest, not in some imagined consent of the governed. While pretending to defend "democracy," the Egyptian military has deposed -- and captured -- the man who was democratically elected president of that country less than one year ago. Oh, yes, and to complete the charade, the military has also suspended the constitution: you know, the document that keeps the government from doing all of the terrible things that it does!

Instead of spending today watching John Wayne and Randolph Scott movies that glorify the butchery of war -- hardly an expression of "independence" from the powers of the state -- minds would be better advised to focus on events in Egypt.  Perhaps the words of Tom Lehrer -- in his song "Send the Marines" -- could provide appropriate accompaniment to military efforts to prevent elections from determining political outcomes in a "democracy":

"For might makes right/ And till they've seen the light/They've got to be protected/All their rights respected/till somebody we like can be elected."

Thumbs Down on the Fourth of July

Thumbs Down on the Fourth of July
by Stephan Kinsella
July 4, 2012

Anthony Gregory has a great  post up on TLS today, Should We Celebrate the American Revolution?, which exposes many myths about the "libertarian" nature of Independence Day and the Revolutionary War. (See also Jeff Tucker and Doug French's column today, The Birth of Sedition.) I previously expressed skepticism of Constitution Day ( Black Armbands for "Constitution Day"). Likewise, it's problematic "Independence Day" is upheld as some sort of libertarian event.

Doing some random wikipedia searching about the Statue of "Liberty," I came across a great quote, from 1886, by an African American newspaper, scoffing at the dedication of the Statue of Liberty (official name: Liberty Enlightening the World) and at the idea that America was a some free country and beacon of liberty. These thoughts express basically how I feel about the 4th of July, celebrations of the Constitution, American "independence," and America's "birthday" (note: by calling July 4–the date the US government may be said to have emerged–the country's birthday, a subtle equation is made between country and state; which is why today yahoos say you are "unpatriotic" or "you hate your country" if you don't "respect the flag" or don't send your kids off to the military meat grinder to fight in its savage wars, etc.):

Shortly after the dedication, the Cleveland Gazette, an African American newspaper, suggested that the statue's torch not be lit until the United States became a free nation "in reality":

"Liberty enlightening the world," indeed! The expression makes us sick. This government is a howling farce. It can not or rather does not protect its citizens within its own borders. Shove the Bartholdi statue, torch and all, into the ocean until the "liberty" of this country is such as to make it possible for an inoffensive and industrious colored man to earn a respectable living for himself and family, without being ku-kluxed, perhaps murdered, his daughter and wife outraged, and his property destroyed. The idea of the "liberty" of this country "enlightening the world," or even Patagonia, is ridiculous in the extreme.

They had a good point. I'm so sick of libertarians upholding America or its Founding slaveholding "Fathers" or the Declaration or the abominable Constitution (the word is rightly used as a swear word in L. Neil Smith's The Probability Broach or Gallatin Divergence, as I recall, as in "Constitution! I just hit my thumb with a hammer!"). Today will see countless American yahoos, the products of government schools, cheering on our "freedom" by singing Lee Greenwood songs and crying when they put their hands over their hearts to worship Old Glory, in violation of the First Commandment.

All these state-sanctioned state-worshiping "patriotic" holidays only serve to equate country with state and to glorify the state and its statism 1 and wars. I'll watch fireworks with my kid tonight, but tell him to enjoy the lights and chemical reactions, not what the state wants it to signify.

The Hypocrisy of American Slavery

The Hypocrisy of American Slavery
Frederick Douglass - July 4, 1852

Fellow citizens, pardon me, and allow me to ask, why am I called upon to speak here today? What have I or those I represent to do with your national independence? Are the great principles of political freedom and of natural justice, embodied in that Declaration of Independence, extended to us? And am I, therefore, called upon to bring our humble offering to the national altar, and to confess the benefits, and express devout gratitude for the blessings resulting from your independence to us?

Would to God, both for your sakes and ours, that an affirmative answer could be truthfully returned to these questions. Then would my task be light, and my burden easy and delightful. For who is there so cold that a nation's sympathy could not warm him? Who so obdurate and dead to the claims of gratitude, that would not thankfully acknowledge such priceless benefits? Who so stolid and selfish that would not give his voice to swell the hallelujahs of a nation's jubilee, when the chains of servitude had been torn from his limbs? I am not that man. In a case like that, the dumb might eloquently speak, and the "lame man leap as an hart."

But such is not the state of the case. I say it with a sad sense of disparity between us. I am not included within the pale of this glorious anniversary! Your high independence only reveals the immeasurable distance between us. The blessings in which you this day rejoice are not enjoyed in common. The rich inheritance of justice, liberty, prosperity, and independence bequeathed by your fathers is shared by you, not by me. The sunlight that brought life and healing to you has brought stripes and death to me. This Fourth of July is yours, not mine. You may rejoice, I must mourn. To drag a man in fetters into the grand illuminated temple of liberty, and call upon him to join you in joyous anthems, were inhuman mockery and sacrilegious irony. Do you mean, citizens, to mock me, by asking me to speak today? If so, there is a parallel to your conduct. And let me warn you, that it is dangerous to copy the example of a nation (Babylon) whose crimes, towering up to heaven, were thrown down by the breath of the Almighty, burying that nation in irrecoverable ruin.

Fellow citizens, above your national, tumultuous joy, I hear the mournful wail of millions, whose chains, heavy and grievous yesterday, are today rendered more intolerable by the jubilant shouts that reach them. If I do forget, if I do not remember those bleeding children of sorrow this day, "may my right hand forget her cunning, and may my tongue cleave to the roof of my mouth!"

To forget them, to pass lightly over their wrongs and to chime in with the popular theme would be treason most scandalous and shocking, and would make me a reproach before God and the world.

My subject, then, fellow citizens, is "American Slavery." I shall see this day and its popular characteristics from the slave's point of view. Standing here, identified with the American bondman, making his wrongs mine, I do not hesitate to declare, with all my soul, that the character and conduct of this nation never looked blacker to me than on this Fourth of July.

Whether we turn to the declarations of the past, or to the professions of the present, the conduct of the nation seems equally hideous and revolting. America is false to the past, false to the present, and solemnly binds herself to be false to the future. Standing with God and the crushed and bleeding slave on this occasion, I will, in the name of humanity, which is outraged, in the name of liberty, which is fettered, in the name of the Constitution and the Bible, which are disregarded and trampled upon, dare to call in question and to denounce, with all the emphasis I can command, everything that serves to perpetuate slavery -- the great sin and shame of America! "I will not equivocate - I will not excuse." I will use the severest language I can command, and yet not one word shall escape me that any man, whose judgment is not blinded by prejudice, or who is not at heart a slave-holder, shall not confess to be right and just.

But I fancy I hear some of my audience say it is just in this circumstance that you and your brother Abolitionists fail to make a favorable impression on the public mind. Would you argue more and denounce less, would you persuade more and rebuke less, your cause would be much more likely to succeed. But, I submit, where all is plain there is nothing to be argued. What point in the anti-slavery creed would you have me argue? On what branch of the subject do the people of this country need light? Must I undertake to prove that the slave is a man? That point is conceded already. Nobody doubts it. The slave-holders themselves acknowledge it in the enactment of laws for their government. They acknowledge it when they punish disobedience on the part of the slave. There are seventy-two crimes in the State of Virginia, which, if committed by a black man (no matter how ignorant he be), subject him to the punishment of death; while only two of these same crimes will subject a white man to like punishment.

What is this but the acknowledgment that the slave is a moral, intellectual, and responsible being? The manhood of the slave is conceded. It is admitted in the fact that Southern statute books are covered with enactments, forbidding, under severe fines and penalties, the teaching of the slave to read and write. When you can point to any such laws in reference to the beasts of the field, then I may consent to argue the manhood of the slave. When the dogs in your streets, when the fowls of the air, when the cattle on your hills, when the fish of the sea, and the reptiles that crawl, shall be unable to distinguish the slave from a brute, then I will argue with you that the slave is a man!

For the present it is enough to affirm the equal manhood of the Negro race. Is it not astonishing that, while we are plowing, planting, and reaping, using all kinds of mechanical tools, erecting houses, constructing bridges, building ships, working in metals of brass, iron, copper, silver, and gold; that while we are reading, writing, and ciphering, acting as clerks, merchants, and secretaries, having among us lawyers, doctors, ministers, poets, authors, editors, orators, and teachers; that we are engaged in all the enterprises common to other men -- digging gold in California, capturing the whale in the Pacific, feeding sheep and cattle on the hillside, living, moving, acting, thinking, planning, living in families as husbands, wives, and children, and above all, confessing and worshipping the Christian God, and looking hopefully for life and immortality beyond the grave -- we are called upon to prove that we are men?

Would you have me argue that man is entitled to liberty? That he is the rightful owner of his own body? You have already declared it. Must I argue the wrongfulness of slavery? Is that a question for republicans? Is it to be settled by the rules of logic and argumentation, as a matter beset with great difficulty, involving a doubtful application of the principle of justice, hard to understand? How should I look today in the presence of Americans, dividing and subdividing a discourse, to show that men have a natural right to freedom, speaking of it relatively and positively, negatively and affirmatively? To do so would be to make myself ridiculous, and to offer an insult to your understanding. There is not a man beneath the canopy of heaven who does not know that slavery is wrong for him.

What! Am I to argue that it is wrong to make men brutes, to rob them of their liberty, to work them without wages, to keep them ignorant of their relations to their fellow men, to beat them with sticks, to flay their flesh with the lash, to load their limbs with irons, to hunt them with dogs, to sell them at auction, to sunder their families, to knock out their teeth, to burn their flesh, to starve them into obedience and submission to their masters? Must I argue that a system thus marked with blood and stained with pollution is wrong? No - I will not. I have better employment for my time and strength than such arguments would imply.

What, then, remains to be argued? Is it that slavery is not divine; that God did not establish it; that our doctors of divinity are mistaken? There is blasphemy in the thought. That which is inhuman cannot be divine. Who can reason on such a proposition? They that can, may - I cannot. The time for such argument is past.

At a time like this, scorching irony, not convincing argument, is needed. Oh! had I the ability, and could I reach the nation's ear, I would today pour out a fiery stream of biting ridicule, blasting reproach, withering sarcasm, and stern rebuke. For it is not light that is needed, but fire; it is not the gentle shower, but thunder. We need the storm, the whirlwind, and the earthquake. The feeling of the nation must be quickened; the conscience of the nation must be roused; the propriety of the nation must be startled; the hypocrisy of the nation must be exposed; and its crimes against God and man must be denounced.

What to the American slave is your Fourth of July? I answer, a day that reveals to him more than all other days of the year, the gross injustice and cruelty to which he is the constant victim. To him your celebration is a sham; your boasted liberty an unholy license; your national greatness, swelling vanity; your sounds of rejoicing are empty and heartless; your shouts of liberty and equality, hollow mock; your prayers and hymns, your sermons and thanksgivings, with all your religious parade and solemnity, are to him mere bombast, fraud, deception, impiety, and hypocrisy - a thin veil to cover up crimes which would disgrace a nation of savages. There is not a nation of the earth guilty of practices more shocking and bloody than are the people of these United States at this very hour.

Go search where you will, roam through all the monarchies and despotisms of the Old World, travel through South America, search out every abuse and when you have found the last, lay your facts by the side of the everyday practices of this nation, and you will say with me that, for revolting barbarity and shameless hypocrisy, America reigns without a rival.

Uhm ... no ... that would be NATURAL rights.
Civil rights are permissions that Government extends/withholds at whim.

In NO case does "government", composed of the employees of the citizens, get to have any sanction over the civil rights of the citizens IN THEIR OWN PRIVATE SPHERES.  The spirit of the Constitution prevents governments from imposing the ideals of any group on any other group or individual.  That simple concept makes socialism (liberalism, progressivism, etc.) criminal.  The 'updated' pledge summarizes the goals for government:  "I Pledge Allegiance to the Flag of the United States of America and to the Democracy-on-demand Republic for which it stands. We're One Nation of individuals who champion fair play, maximum civil liberties, the Right of self-determination, and having an efficient, unobtrusive and deferential government."  John A. Re: Schumer: Illegal Immigration is a ‘Civil Right’

MJ:  Civil rights are what the Founding Fathers 'thought' they were guaranteeing via the original Constitution. Voting, for instance is a 'civil' right.

Migration, however, is a (natural) right.
Legitimate Governments SECURE (natural) rights. see Declaration of Independence

Having read the Constitution numerous times ... STILL do not know what 'illegal immigration' might be.
