The result of this election is amusing. Bruce Austin is the 24 year incumbent board member of the Houston Community College System. He is a black guy. Dave Wilson is an anti-gay Right Wing Republican white guy. They ran in a predominantly black district for the board position.

Dave Wilson, the white guy, sent out mailers with smiling pictures of black families without his picture. On his material he also indicated that he was endorsed by Ron Wilson, a cousin. The deception is that Ron Wilson is a very well-known black politician in the district.

Bruce Austin seemed to have been caught off guard and began sending the counter mailers with a picture of Dave Wilson, the white guy. He also included his rap sheet.

calling him a "right-wing hate monger" and saying he "advocated bringing back chain gangs to clean highways." But the campaign clearly caught him off guard. [KHOU]

Ultimately, Dave Wilson, the white guy, won the election by 26 votes. Mr. Austin said that he will ask for a recount. He also said he does not think this is good for democracy. Mr. Wilson shows no remorse for his deceptive mailers. He said that politicians deceive voters every time they speak.

White Guy Deceiving Black Voters?

There are many assumptions here. Mr. Wilson made the assumption that because he was running in a black district he had to make the citizens believe he was black to win the election. Mr. Austin made the assumption that highlighting that Mr. Wilson is white and stating he was a right-wing hate monger would get him his win.

The reality is that they were both likely wrong. It is insulting to blacks to assume that pigmentation plays a decisive role in candidate selection. The reality is that minorities have a much harder time getting whites to vote for them than the converse. The recent mayoral race in Detroit proves this. 82% of Detroit is black, yet they elected a white mayor. He earned their votes with the policies he is proposing.

One wonders whether the voters wanted to vote out the 24 year incumbent on a troubled school board. Given the values of the community, it is unlikely that Wilson would have been their choice. One wonders whether Mr. Austin simply took his constituents for granted.

"I suspect it's more than just race," says Bob Stein, the Rice University political scientist and KHOU analyst. "The Houston Community College was under some criticism for bad performance. And others on the board also had very serious challenges." [KHOU]

Is the closeness of the election a result of people flocking back to Mr. Austin after they figured out that the other guy was a Right Winger? Or was the closeness of the vote based on frustration with an incumbent in a troubled system? The most important lesson is that one must know who they are voting for on elections one considers consequential.

Supreme Court Justice Louis Brandeis once remarked that "the reason why the public thinks so much of the Justices is that they are almost the only people in Washington who do their own work." However, according to Clark M. Neily III, judges at all levels might still be doing their own work, but are abdicating their responsibility, as James Madison put it, to serve as an "impenetrable bulwark against every assumption of power in the legislative or executive."

Neily argues that the judiciary's knee-jerk deference to the other branches has resulted in an explosion in the size, cost, and intrusiveness of government. In any given year, the Supreme Court strikes down just three of the five thousand laws passed by federal and state governments. Unfortunately, this reflexive restraint toward other branches led to the Affordable Care Act being upheld last year and the approval of eminent domain for economic development purposes in Kelo v. City of New London (2005).

Neily has spent his career fighting against the unconstitutional expansion of government and a more properly engaged judiciary. He is the director of the Institute for Justice's Center for Judicial Engagement, and he served as co-counsel for the plaintiffs in the watershed Second Amendment case, District of Columbia v. Heller.

California Wind Farm Seeking First Permit to Kill Protected Golden Eagles

(CNSNews.com) – A wind farm in the Montezuma Hills region of Northern California is seeking a permit to legally kill up to five golden eagles over the next five years even though the raptors are currently protected under federal law and an international migratory bird treaty.

Noting that "the project contributes to California's Renewable Energy Portfolio Standard goals," the U.S. Fish & Wildlife Service (FWS) has recommended a five-year permit with additional mitigation and monitoring efforts, including the purchase of "conservation credits in an approved mitigation bank."

Due to the government shutdown last month, the public comment period on the permit has been extended to Nov. 12th.

If approved, the 3,500-acre Shiloh IV Wind Project in Solano County, which is owned by EDF Renewable Energy, would receive the nation's first "eagle take permit" allowing the project's 50 two-megawatt wind turbines to legally kill the birds of prey without penalty. An estimated 315 birds and 258 bats will be killed by each turbine per year, according to the project's Draft Environmental Assessment (DEA). (See Shiloh DEA.pdf)

Earlier this year, a similar wind farm in Nevada faced a $200,000 fine for killing a single golden eagle without a take permit.

The Migratory Birds Treaty and the Bald & Golden Eagle Protection Act forbid the killing of even one of the estimated 527 golden eagles that live within 140 miles of the project area. "Wind facilities are believed to be one of the currently leading causes of mortality," according to the DEA.

According to a new FWS study published in September in the Journal of Raptor Research, eagle deaths have spiked in recent years, with wind farms killing "at least 85 eagles" in 10 states between 1997 and 2012.

Seventy-nine of the  fatalities were golden eagles who inadvertently flew into spinning  turbine blades. One was electrocuted by a high-power line.

However, the study, which "excluded 17 eagle deaths for which there was 'not enough evidence'," warned that due to the lack of monitoring and voluntary reporting by wind-energy companies, that figure "substantially underestimates" total eagle mortality from wind turbines.

The DEA determined that nesting adult eagles and their offspring found within 10 miles of the wind farm "are at risk from project operations." Although EDF replaced 230 of its 1980s –era wind turbines with 50 newer ones, FWS noted that the risk to eagles has actually "increased because of the larger size of the turbine blades."

Golden eagles, one of the largest raptors in North America, are particularly vulnerable to wind turbines because they tend to look down for prey while they are in flight.

A recent FWS estimate put the total population of golden eagles at 20,722. A 2009 analysis of the golden eagle populations in the Shiloh IV area found that it "might not be able to sustain any additional unmitigated mortality, and set the thresholds for this species at zero,"and any authorized killing must be offset by "compensatory mitigation" efforts.

EDF Renewable Energy, which has a number of wind, solar and biomass projects throughout the country, signed a purchase agreement with Pacific Gas & Electric Company (PG&E) to provide wind-powered electricity to the utility over the next 25 years. A mandate passed by the California legislature requires that 33 percent of the state's electricity comes from renewable sources by 2020.

The American Recovery and Reinvestment Act of 2009 and the American Taxpayer Relief Act of 2012 allow a 2.3-cent per-kilowatt-hour tax credit for wind projects such as Shiloh IV. According to the DOE, the federal government spent $9.7 billion on 24,711 renewable energy projects, with 79 percent going to wind energy projects.

The Valley Morning Star reports that Texas state Sen. Wendy Davis (D-Fort Worth), who is running for governor of Texas and became nationally known after she stood for an eleven-hour pro-abortion filibuster, astonishingly claimed to be "pro-life" while campaigning at the University of Texas at Brownsville.

"I am pro-life. I care about the life of every child: every child that goes to bed hungry, every child that goes to bed without a proper education, every child that goes to bed without being able to be a part of the Texas dream, every woman and man who worry about their children's future and their ability to provide for that future. I care about life and I have a record of fighting for people above all else."

Davis continued, "When I believe women's health is in danger, I'm going to stand and fight to protect that. This isn't about protecting abortion," she deflected. "It's about protecting women. It's about trusting women to make good decisions for themselves and empowering them with the tools to do that."

If Davis is trying to appear compassionate, it's going to be a stretch. During her filibuster, in order to strengthen her pro-abortion stance, she implied that the 20-week old fetus does not feel pain. She answered a question about the subject by stating:

"Now, once again I refer to the section of the bill: "the State has a compelling state interest in protecting the lives of unborn children from the stage at which substantial medical evidence indicates that these children are capable of feeling pain." The abstract that I just read to you refutes that. There are other articles that refute that as well."

These days, the ability to look you straight in the eye and lie through your teeth without any pains of conscience is an art form in American government, both Republican and Democrat. ~ TD
